CSPA Child Protection Act Calculator

The biggest worry for many parents preparing for Employment-Based Immigration is that their children will be over the age of 21 while the formalities take longer. You lose your “child status”.
To alleviate these problems, U.S. immigration law has a system called CSPA (Child Status Protection Act).

What is CSPA?

CSPA recalculates the child's age based on the immigration petition (I-130, I-140, etc.) This is a regulation that determines whether a child can be legally recognized as under 21 years old and protected as a companion child even if the actual age is over 21 years old.
NIW calculates your CSPA age based on the following factors:

  • 1. Child’s actual age (as of the date the visa door opens and final permanent residence can be applied for)
  • 2. Period during which I-140 was received (period of stay until immigration review date/approval date)
CSPA Age = (Actual Age at Opening of Visa Door Chart A / Final Action Date) - (I-140 Pending Period) If this calculation results in under age 21, your child may be “CSPA protected” under certain requirements.

  • Judging by intuition, “When do I have to file an I-140?” or “Will my child be protected when the visa door opens?”can be a fatal misjudgment.
