CSPA Child Status Protection Act Calculator
The biggest concern for many parents preparing for employment-based immigration is their children losing
"Child Status" by turning 21 while the process is delayed.
To mitigate this issue, US immigration law provides the CSPA (Child Status Protection Act).
What is CSPA?
CSPA recalculates a child's age based on the immigration petition (I-130, I-140, etc.) to determine if they can be legally considered under 21 years old despite their actual age.
For employment-based immigration (EB-1, EB-2 NIW, EB-3, etc.), the CSPA age is calculated based on:
- 1. Child's actual age (on the date the visa becomes available/Final Action Date)
- 2. The period the I-140 was pending (Time between filing and approval)
CSPA Age = (Age at Final Action Date) - (I-140 Pending Time)
If the result is under 21, the child may be eligible for "CSPA Protection".
Why do you need a CSPA Calculator?
- Due to visa backlogs and administrative delays, children can easily turn 21 while waiting.
- Guessing "Until when should I file I-140?" or "Is my child protected?" can lead to critical errors.
- This calculator is designed to check the estimated CSPA age and eligibility by simply entering the child's DOB, I-140 filing/approval dates, and the Visa Bulletin date (Final Action Date).
Check Before Use
- This calculator is a "reference tool" and not an official legal opinion.
- Actual CSPA eligibility depends on comprehensive factors:
- Accurate Priority Date
- I-140 Pending Period
- Whether you "Sought to Acquire" within 1 year of visa availability
- Please consult with an immigration attorney for individual case advice before making important decisions.
