EB-3 Unskilled Employment-Based Immigration: I-140 Immigrant Petition Approved

We would like to explain in detail the I-140 immigrant petition, one of the most important steps in the U.S. employment-based immigration process.



In U.S. employment-based permanent residency, this is the official procedure for proving immigrant eligibility to UCSIS -
the stage at which the employer or the applicant petitions USCIS, asserting that this person is qualified to receive U.S. permanent residency.

Among the U.S. immigration categories, in the case of EB-1B, EB-2(employment-based), EB-3(skilled/unskilled),
an employer is required, so the I-140 filing is mandatory.

I-140 Approval: Procedure Summary

PERM Labor Certification approval (if an employer is required)
I-140 immigrant petition filing (employer or applicant)
Document review → approval
NVC transfer, then an immigrant visa interview or, inside the United States, I-485 filing


I-140 reviews are currently taking roughly 10 months or more as of 2025,
and with Premium Processing a separate additional cost applies.(additional cost $2,805)

In particular, during the I-140 stage, the chance of denial is high if the employer's credibility is lacking,
and submitting false work history or false documents can lead to denial of the entire immigration case.

I-140 approval alone does not complete permanent residency; NVC processing or I-485 must be completed before final permanent residency approval is granted.

I-140 is the ‘central stage’ of U.S. employment-based immigration,
and depending on how the documents are assembled and on the strategy, it can decide the success or failure of the entire immigration case.
Approval does not come simply from filing;
