10월 1일, 취업이민 영주권 쿼터가 더 늘어날 수 있을까?
매년 10월 1일은 미국 취업이민을 기다리는 신청자들에게 중요한 시점입니다. 미국 정부의 새로운 회계연도가 시작되면서 EB-1, EB-2, EB-3 등 취업이민에 사용할 수 있는 새로운 연간 비자 쿼터가 열리기 때문입니다.
특히 EB-2 NIW 신청자라면 이 시기에 자주 언급되는 ‘Visa Spillover’를 눈여겨볼 필요가 있습니다. 전년도 가족초청이민에서 사용되지 않은 비자 숫자가 다음 회계연도의 취업이민 쿼터에 추가될 수 있기 때문입니다.
■ Visa Spillover란 무엇인가?
미국 취업이민에는 매년 최소 140,000개의 이민비자 번호가 배정됩니다. 하지만 전년도 가족초청이민 우선순위 카테고리에서 사용되지 않은 비자 번호가 있다면, 그 숫자는 다음 회계연도의 취업이민 전체 쿼터에 추가됩니다.
실제로 2026 회계연도의 취업이민 비자 한도는 기본 140,000개가 아니라 186,317개로 정해졌습니다. 전년도 가족초청이민에서 사용되지 않은 숫자가 넘어오면서 취업이민에서 사용할 수 있는 비자 번호가 46,317개 늘어난 것입니다.
여기서 말하는 비자 숫자는 주신청자만을 의미하지 않습니다. 배우자와 자녀 등 동반가족도 같은 취업이민 쿼터를 사용하기 때문에, 186,317개가 곧 186,317명의 근로자에게 영주권이 발급된다는 의미는 아닙니다.
■ 왜 10월 1일이 중요한가?
미국의 회계연도는 매년 10월 1일부터 다음 해 9월 30일까지입니다. 따라서 2026년 10월 1일부터는 2027 회계연도가 시작되고, 새로운 취업이민 비자 쿼터가 사용되기 시작합니다.
2026 회계연도에 가족초청이민 비자가 얼마나 남는지에 따라 FY2027 취업이민 전체 쿼터가 140,000개보다 더 커질 수 있습니다. 다만 정확한 FY2027 취업이민 한도가 반드시 10월 1일에 바로 확정되는 것은 아니며, 정부가 실제 비자 사용량을 집계한 뒤 최종 숫자를 산정할 수도 있습니다.
■ NIW 신청자에게는 어떤 의미가 있을까?
NIW는 별도의 독립된 비자 카테고리가 아니라 EB-2에 포함됩니다. 따라서 Visa Spillover가 발생해 취업이민 전체 쿼터가 늘어나면, EB-2가 배정받을 수 있는 비자 숫자도 함께 증가할 수 있습니다.
EB-2는 일반적으로 전체 취업이민 비자 쿼터의 약 28.6%를 배정받습니다. 여기에 EB-1에서 사용되지 않은 비자 번호가 발생하면 그 숫자가 EB-2로 넘어올 수도 있습니다.
즉, NIW 신청자 입장에서는 두 가지를 함께 볼 필요가 있습니다. 가족초청이민에서 취업이민으로 넘어오는 비자가 많아져 전체 취업이민 쿼터가 커지는지, 그리고 EB-1에서 사용되지 않은 비자가 추가로 EB-2에 내려오는지가 중요합니다.
다만 NIW만을 위해 별도로 확보된 비자 쿼터가 있는 것은 아닙니다. NIW 신청자는 일반적인 고용주 스폰서 방식의 EB-2 신청자들과 동일한 EB-2 비자 쿼터를 함께 사용합니다.
■ Spillover가 많으면 문호도 바로 전진할까?
비자 숫자가 늘어나는 것은 분명 긍정적인 요소지만, Visa Spillover가 발생한다고 해서 EB-2 문호가 자동으로 크게 전진하는 것은 아닙니다. 문호는 실제 대기 수요, 국가별 제한, 이미 접수되어 있는 케이스의 수, USCIS와 국무부의 비자 사용 속도 등을 종합적으로 고려해 결정됩니다.
그럼에도 전체적으로 사용할 수 있는 비자 숫자가 많아진다는 것은 분명 중요한 변수입니다. 특히 최근 몇 년처럼 EB-2 문호가 정체되거나 후퇴하면서 NIW 신청자들의 대기기간이 길어진 상황에서는 새로운 회계연도의 비자 쿼터가 얼마나 확보되는지가 더욱 중요해집니다.
■ 올해는 예측이 더 어렵다
올해는 한 가지 특이한 점이 있습니다. 미국 국무부는 통상 매월 이민비자 발급 통계를 공개해 왔지만, 현재 공개된 2026 회계연도 월별 자료는 2026년 2월까지만 확인되고 있습니다.
물론 이 자료만으로 전체 가족초청이민 비자 사용량을 계산할 수 있는 것은 아닙니다. 미국 내에서 USCIS를 통해 신분조정을 하는 경우에도 비자 쿼터가 사용되며, 국무부 역시 월별 발급 통계를 단순 합산해 공식 누적 사용량으로 계산해서는 안 된다고 안내하고 있습니다.
그럼에도 예년처럼 최근 월별 자료가 계속 공개되고 있었다면 비자 사용 흐름을 가늠하는 데 참고할 수 있었을 것입니다. 올해는 3월 이후의 공식 월별 자료가 공개되지 않고 있어, 9월 30일까지 가족초청이민 비자가 얼마나 남을지 평소보다 예측하기 어려운 상황입니다.
■ NIW 신청자가 앞으로 봐야 할 것은?
가장 먼저 확인해야 할 것은 FY2027의 최종 취업이민 비자 한도입니다. 2026 회계연도에 가족초청이민 비자가 상당수 남는다면, 10월 1일부터 시작되는 새로운 회계연도에도 취업이민 전체 쿼터가 기본 140,000개보다 크게 늘어날 가능성이 있습니다.
그 이후에는 EB-1과 EB-2의 실제 비자 사용량, 그리고 매달 발표되는 Visa Bulletin의 움직임을 함께 지켜봐야 합니다. October 1 자체가 NIW 문호의 빠른 전진을 보장하는 것은 아니지만, 새로운 비자 쿼터가 열리고 추가 Spillover 가능성까지 있다는 점에서 FY2027의 시작은 NIW 신청자들에게 중요한 시점이 될 수 있습니다.

Could More Employment-Based Green Cards Become Available on October 1?
October 1 marks the beginning of a new U.S. government fiscal year, and that matters for anyone waiting in an employment-based green card category. A new annual supply of immigrant visa numbers becomes available for EB-1, EB-2, EB-3, and the other employment-based preference categories.
It is also the time of year when “visa spillover” becomes especially important. Depending on how many family-sponsored preference visa numbers went unused during the previous fiscal year, the employment-based categories may begin the new fiscal year with substantially more visa numbers than the normal annual base.
■ What Is Visa Spillover?
Employment-based immigration normally starts with an annual worldwide limit of at least 140,000 visa numbers. If some family-sponsored preference visa numbers were not used during the previous fiscal year, those unused numbers are added to the employment-based limit for the following fiscal year.
We saw this in Fiscal Year 2026. Instead of the normal 140,000 base, the final worldwide employment-based limit was 186,317. That meant 46,317 additional employment-based visa numbers were available because of unused family-sponsored preference numbers from the prior year.
These numbers include principal applicants as well as spouses and children who receive immigrant visas as derivative beneficiaries. So an annual limit of 186,317 does not mean that 186,317 individual workers can receive green cards.
■ Why October 1st Matters
The U.S. fiscal year runs from October 1 through September 30. Fiscal Year 2027 therefore begins on October 1, 2026, and unused family-sponsored preference numbers from Fiscal Year 2026 can increase the employment-based visa supply for the new year.
The final FY2027 employment-based limit may not necessarily be formally announced on October 1. The government can initially work from estimates and later determine the exact annual limit after the necessary visa-usage data are available. Still, October 1 is when the new fiscal-year visa supply begins.
■ Who Gets the Additional Visa Numbers?
Unused family-sponsored visa numbers first increase the overall employment-based annual limit. That larger pool is then divided among the employment-based preference categories under the usual statutory formula.
For NIW applicants, the important category is EB-2. EB-2 generally receives about 28.6 percent of the worldwide employment-based limit. It can also receive additional numbers that EB-1 does not use.
This means NIW applicants can benefit in two ways. First, if family-sponsored visa numbers spill over into the employment-based system, the overall EB-2 allocation becomes larger. Second, if EB-1 does not use all of its available numbers, some of those numbers can move down to EB-2.
NIW does not have a separate visa quota within EB-2. NIW applicants share the same EB-2 visa numbers with other EB-2 applicants. For that reason, the size of the overall employment-based limit and the amount of visa usage in EB-1 can both affect how much visa availability ultimately reaches EB-2 NIW cases.
■ Does More Spillover Mean Faster Visa Bulletin Movement?
Not automatically. A larger employment-based visa supply gives the Department of State and USCIS more numbers to work with, which can create better conditions for Final Action Dates to move forward.
Actual movement still depends on demand within each category, country limits, pending cases, and how quickly visa numbers are being used. A large spillover can therefore be very helpful without necessarily producing dramatic movement in every EB category.
■ Why FY2027 Is Harder Than Usual to Predict
There is one unusual complication this year. The Department of State normally publishes monthly immigrant visa issuance statistics throughout the fiscal year, but the publicly available FY2026 reports currently stop at February 2026.
Those monthly reports do not provide the entire picture because USCIS adjustment-of-status approvals also consume family-sponsored preference visa numbers. The State Department also cautions that its monthly reports should not simply be added together and treated as an official fiscal-year total. Even so, the absence of more recent monthly data removes one of the indicators normally available when trying to estimate visa usage late in the fiscal year.
As a result, it is difficult to predict with confidence how many family-sponsored preference numbers will remain unused on September 30. That also makes it difficult to predict exactly how much larger the FY2027 employment-based limit could be.
■ What Should EB Applicants Watch Next?
The first number to watch will be the FY2027 worldwide employment-based visa limit. If a substantial number of family-sponsored preference visas remain unused in FY2026, employment-based applicants could once again begin the new fiscal year with considerably more than the normal 140,000 visa numbers available.
After that, applicants should watch how those numbers are actually used across EB-1, EB-2, and EB-3. October 1 does not guarantee faster Visa Bulletin movement, but a larger visa pool gives the government more capacity to approve employment-based green card cases during the new fiscal year.
For applicants waiting through a long backlog, that makes the start of FY2027 particularly worth watching.
