NIW가 너무 오래 계류 중인데, 상원의원에게 연락하면 실제로 도움이 될까?

NIW 관련 커뮤니티나 포럼을 오래 보다 보면 반복해서 등장하는 조언이 있습니다. I-140 이민청원서가 비정상적으로 오래 계류 중이고, 일반적인 USCIS 문의 절차를 이용해도 별다른 답변을 받지 못한다면 연방 상원의원(Senator)이나 하원의원(Congressional Representative) 사무실에 도움을 요청해 보라는 것입니다.

최근 한 NIW 신청자가 이런 조언이 자주 등장하는 이유를 보여주는 사례를 공유했습니다. 해당 신청자의 I-140은 2023년 12월 1일부터 계속 계류 중이었던 것으로 알려졌습니다. 이후 상원의원실에 도움을 요청했고, 결국 USCIS로부터 해당 청원서가 추가 심사 중이며 심사 완료 시점은 안내할 수 없다는 답변을 받았습니다.

다만 USCIS의 답변 마지막에는 조금 더 긍정적으로 들리는 문장이 포함되어 있었습니다.

“귀하의 문의 내용을 담당 부서에 전달했으며, 해당 케이스에 대한 우선처리를 요청했습니다.”

수년간 기다려 온 신청자라면 “우선처리를 요청했다(requested prioritization)”는 문구를 보고 의회 의원실의 개입으로 드디어 케이스가 앞으로 진행되기 시작했다고 받아들일 수 있습니다. 하지만 같은 답변에서 USCIS는 여전히 심사 완료 시점을 안내할 수 없다고 밝혔습니다.

이 차이를 이해하는 것이 중요합니다. 연방 상원의원이나 하원의원실은 USCIS에 케이스 진행 상황을 문의하거나 장기간 지연된 케이스를 담당 부서에 전달할 수 있습니다. 그러나 이러한 문의가 접수되었다고 해서 USCIS에 새로운 심사 기한이 자동으로 부여되는 것은 아닙니다.

■ NIW 처리기간은 이미 상당히 길어져 있습니다

2026년 9월 16일 기준 USCIS는 NIW Form I-140의 처리기간을 Service Center Operations 기준 약 29개월로 안내하고 있습니다.

하지만 이 29개월이라는 숫자가 모든 NIW를 29개월 안에 심사하겠다는 USCIS의 약속을 의미하는 것은 아닙니다. USCIS의 처리기간은 최근 6개월 동안 실제로 심사가 완료된 케이스를 기준으로, 그중 80%가 처리되는 데 걸린 기간을 계산한 수치입니다.

따라서 USCIS 홈페이지에 처리기간이 29개월로 표시되어 있다면, 최근 완료된 NIW 케이스의 80%가 29개월 이내에 심사되었다는 의미입니다. 일부 케이스는 그보다 빨리 승인되지만, 반대로 더 오래 걸리는 케이스도 있습니다.

이 때문에 다른 NIW 신청자의 진행 상황과 자신의 케이스를 단순 비교하는 것은 정확하지 않을 수 있습니다. 나보다 늦게 접수한 사람이 먼저 승인을 받을 수도 있고, 비슷한 경력을 가진 신청자라도 훨씬 더 오랜 기간 계류될 수 있습니다.

■ 접수증에 표시된 서비스센터만으로는 전체 진행 상황을 알기 어렵습니다

과거에는 I-140 접수증에 Nebraska, Texas 등 어느 서비스센터가 표시되어 있는지를 확인하고 서비스센터별 처리속도를 비교하는 경우가 많았습니다.

하지만 최근 USCIS의 공개 처리기간 안내 방식은 점차 이러한 구조에서 벗어나고 있습니다. 일부 서류의 경우 USCIS는 이제 개별 서비스센터 대신 보다 포괄적인 Service Center Operations라는 명칭을 사용하고 있습니다. 업무량과 인력 배치에 따라 케이스가 서로 다른 장소에서 처리될 수 있기 때문입니다.

USCIS 통지서에는 여전히 특정 서비스센터가 표시될 수 있지만, 해당 I-140이 심사기간 내내 하나의 서비스센터 대기열에만 머무른다는 의미는 아닙니다. 따라서 개별 신청자 간 처리속도를 비교하는 것은 더욱 어려워졌습니다.

■ 먼저 접수했다고 반드시 먼저 결과가 나오는 것은 아닙니다

USCIS는 기본적으로 접수 순서에 따라 케이스를 처리하지만, 취업이민 청원서가 항상 완벽한 접수일 순서대로 심사되는 것은 아닙니다.

현재 USCIS는 Form I-140과 관련하여 Visa Bulletin, 즉 미국 영주권 문호상 이민비자 번호가 사용 가능한 경우 Service Center Operations에서 해당 케이스를 우선적으로 처리할 수 있다고 안내하고 있습니다.

이렇게 하면 연계된 I-485 신분조정 케이스를 진행할 수 있고, 해당 회계연도에 배정된 취업이민 비자 쿼터를 보다 효율적으로 사용할 수 있습니다.

따라서 나보다 늦게 접수된 NIW가 먼저 승인되었다고 해서 자신의 케이스가 누락되었거나 잘못 처리되고 있다고 단정할 수는 없습니다.

■ Case Inquiry Date는 또 다른 기준을 사용합니다

많은 신청자가 놓치는 부분이 하나 더 있습니다. USCIS가 공개하는 일반 처리기간과 공식적으로 케이스 지연 문의를 할 수 있는 Case Inquiry Date는 서로 다른 기준으로 계산됩니다.

USCIS 홈페이지에 표시되는 일반 처리기간은 최근 심사 완료 케이스의 80%가 처리되는 데 걸린 기간을 기준으로 합니다.

반면 Case Inquiry Date는 93%의 케이스가 처리되는 데 걸린 기간을 기준으로 계산됩니다.

따라서 USCIS 홈페이지에 표시된 일반 처리기간을 이미 넘겼더라도, 아직 “정상 처리기간을 초과한 케이스(outside normal processing time)”로 공식 문의할 수 없는 상황이 발생할 수 있습니다.

이미 2년 또는 3년에 가까운 시간을 기다린 신청자 입장에서는 바로 이런 시점부터 상원의원이나 하원의원실의 도움을 고려하게 되는 경우가 많습니다.

■ 상원의원이나 하원의원실이 USCIS에 문의하면 어떻게 될까?

연방 상원의원과 하원의원실에는 지역구 주민을 대신해 USCIS와 공식적으로 소통할 수 있는 채널이 마련되어 있습니다.

의원실은 현재 계류 중인 케이스의 진행 상황을 문의하거나, 비정상적으로 장기간 지연되고 있는 문제를 제기하거나, 특정 행정상의 문제를 USCIS에 전달할 수 있습니다.

특히 일반적인 USCIS 문의를 통해 별다른 정보를 받지 못한 경우에는 이러한 의회 문의(Congressional Inquiry)가 도움이 될 수 있습니다.

다만 의원실이 USCIS에 문의했다는 이유만으로 심사속도가 반드시 빨라진다고 생각해서는 안 됩니다.

앞서 소개한 사례에서도 USCIS는 담당 부서에 해당 케이스를 전달하고 우선처리를 요청했다고 밝혔습니다. 하지만 동시에 심사 완료까지 얼마나 걸릴지는 안내할 수 없다고 답변했습니다.

즉, 의회 의원실의 문의로 인해 USCIS가 해당 케이스를 다시 확인하거나 추가적인 관심을 기울였을 가능성은 있지만, 특정 기간 내에 반드시 심사결정을 내려야 하는 공식 절차가 새롭게 시작된 것은 아닙니다.

■ 프리미엄 프로세싱에는 명확한 처리기한이 있습니다

NIW 신청자가 USCIS의 명확한 응답기한을 원하는 경우라면 프리미엄 프로세싱(Premium Processing)은 의회 문의와 본질적으로 다른 제도입니다.

NIW I-140은 Form I-907을 통해 프리미엄 프로세싱을 신청할 수 있으며, 현재 USCIS는 이 카테고리에 대해 45일의 프리미엄 프로세싱 처리기한을 두고 있습니다.

물론 프리미엄 프로세싱을 신청한다고 해서 승인이 보장되는 것은 아닙니다.

USCIS는 승인(Approval)을 할 수도 있고, 거절(Denial)을 할 수도 있으며, 추가서류요청(RFE, Request for Evidence), 거절예정통지(NOID, Notice of Intent to Deny)를 발송하거나 다른 심사 조치를 취할 수도 있습니다.

중요한 차이는 프리미엄 프로세싱은 USCIS가 공식적으로 운영하는 제도이며 정해진 처리기한이 있다는 점입니다.

반면 상원의원이나 하원의원실에서 USCIS에 문의했다고 해서 동일한 심사기한이 새롭게 적용되는 것은 아닙니다.

■ 그렇다면 상원의원에게 연락하는 것이 실제로 도움이 될까?

신청자가 무엇을 원하는지에 따라 도움이 될 수 있습니다.

비정상적으로 오래 지연되고 있는 케이스의 현재 상태를 확인하거나, 행정적인 문제가 있는지 USCIS에 확인해 달라고 요청하거나, 일반적인 USCIS 문의 채널을 통해 제대로 전달되지 않은 사정을 알리고자 한다면 의회 의원실의 도움을 받아볼 수 있습니다.

하지만 상원의원에게 연락하면 NIW 케이스가 자동으로 다른 신청자보다 먼저 심사된다고 기대하는 것은 전혀 다른 문제입니다.

글의 앞부분에서 소개한 USCIS 답변이 이를 잘 보여줍니다.

“우선처리를 요청했다(Requested Prioritization)”는 표현은 분명 긍정적으로 들립니다. 그러나 USCIS는 동시에 심사가 언제 완료될지에 대해서는 어떠한 기간도 제시하지 않았습니다.

현재 NIW 처리기간이 29개월까지 안내되고 있는 상황에서 신청자들이 기다리는 시간을 조금이라도 줄일 방법을 찾는 것은 당연합니다.

의회 의원실을 통한 문의도 분명 활용할 수 있는 방법 중 하나입니다. 그러나 처리기간이 상당히 지연되어 보인다고 하더라도, 이를 USCIS의 일반 심사절차를 건너뛸 수 있는 일종의 지름길로 이해해서는 안 됩니다.

USCIS가 장기간 계류 중인 케이스를 다시 확인하도록 요청하고 싶은 신청자라면 상원의원이나 하원의원실의 도움을 고려해 볼 수 있습니다.

반면 NIW I-140 심사에 대해 명확한 USCIS 처리기한을 원하는 신청자라면, 프리미엄 프로세싱은 의회 문의와는 본질적으로 다른 수단입니다.

Your NIW Has Been Pending Forever. Will Calling a Senator Actually Help?

Anyone who spends enough time in NIW forums will eventually come across the same advice. When an I-140 has been pending for an unusually long time and normal USCIS inquiry channels seem to lead nowhere, someone will suggest contacting a senator or congressional representative.

A recent NIW applicant shared an experience that shows why this advice has become so common. His I-140 had reportedly been pending since December 1, 2023. After contacting a senator’s office, he eventually received a response from USCIS stating that the petition remained under further review and that no timeframe for completion could be provided.

The response ended with a more encouraging sentence:

“We have notified the appropriate unit of your inquiry and requested prioritization.”

After waiting for years, most applicants would read “requested prioritization” as a sign that congressional intervention had finally moved the case forward. But USCIS had also said, in the same response, that it still could not provide a timeframe for completion.

That distinction is important. A congressional office can ask USCIS to look into a case and bring an unusual delay to the agency’s attention, but that does not automatically create a new deadline for adjudication.

■ NIW processing times are already extremely long

As of September 16, 2026, USCIS lists the processing time for NIW Form I-140 petitions at 29 months under Service Center Operations.

That number does not mean USCIS promises to decide every NIW within 29 months. USCIS calculates the processing time by looking at cases adjudicated during the previous six months and determining how long it took to complete 80 percent of them.

So when the website shows 29 months, it means 80 percent of recently completed NIW cases were adjudicated within 29 months. Some cases finished sooner, while others took longer.

This is why comparing your petition with another applicant’s case can be misleading. Someone who filed later may receive an approval first, while another applicant with a similar background continues waiting.

■ The service center on your receipt no longer tells the whole story

Applicants used to pay close attention to whether their I-140 receipt showed Nebraska, Texas, or another service center and compare processing speeds accordingly.

USCIS has been moving away from that model in its public processing-time reporting. For certain forms, the agency now uses the broader Service Center Operations designation because cases may be handled at different locations depending on workload and staffing.

A USCIS notice may still identify a specific service center, but that does not necessarily mean the petition remains in one fixed queue throughout adjudication. This makes comparisons between individual cases even less reliable.

■ Filing earlier does not always mean receiving a decision earlier

USCIS generally processes cases in the order received, but employment-based petitions do not necessarily move through a perfectly chronological line.

For Form I-140, USCIS currently notes that Service Center Operations may give priority to cases when the Visa Bulletin shows that an immigrant visa is available. This allows related adjustment-of-status cases to move forward and helps USCIS use available employment-based visa numbers.

As a result, seeing a later-filed NIW approved before yours does not necessarily mean that your case has been forgotten or mishandled.

■ Even the case inquiry date uses a different standard

Another point applicants often miss is that the published processing time and the date when USCIS allows a formal case inquiry are based on different thresholds.

The processing time shown on the USCIS website reflects the time required to complete 80 percent of adjudicated cases. The Case Inquiry Date is based on the time required to complete 93 percent.

This means an applicant can already be beyond the published processing time and still be told that the case is not yet eligible for an outside-normal-processing inquiry. For someone who has already been waiting close to two or three years, that is often when congressional assistance starts to look attractive.

■ What happens when a congressional office contacts USCIS?

Congressional offices have formal channels for communicating with USCIS on behalf of constituents. They can ask for information about a pending case, raise an unusual delay, or bring a specific problem to the attention of the agency.

That can be useful, particularly when ordinary USCIS inquiries have produced little information. The problem is assuming that the inquiry itself forces USCIS to adjudicate the case faster.

The example above shows the difference. USCIS said that the appropriate unit had been notified and that prioritization had been requested, but it also said that no timeframe for completion could be provided.

In other words, the inquiry may have caused USCIS to give the case additional attention without placing it into a formal process requiring adjudicative action within a fixed number of days.

■ Premium Processing comes with an actual timeframe

For NIW applicants who want a defined USCIS response period, Premium Processing is fundamentally different.

NIW I-140 petitions are eligible for Premium Processing through Form I-907, and USCIS currently provides a 45-day Premium Processing timeframe for this category.

Premium Processing does not guarantee approval. USCIS can approve the petition, deny it, issue a Request for Evidence, issue a Notice of Intent to Deny, or take another action.

The important difference is that Premium Processing is an established USCIS service with a defined timeframe. A congressional inquiry does not create that same clock simply because a senator or representative has contacted the agency.

■ So does contacting a senator actually help?

It can, depending on what the applicant is trying to accomplish.

If the goal is to obtain information about an unusually delayed case, bring a possible administrative problem to USCIS’s attention, or communicate circumstances that ordinary inquiry channels have not addressed, congressional assistance may be worthwhile.

If the expectation is that contacting a senator will automatically move an NIW petition to the front of the line, that is a very different matter.

The USCIS response quoted at the beginning of this article is a good example. “Requested prioritization” sounds encouraging, but USCIS still refused to provide a timeframe for completion.

With NIW processing times now listed at 29 months, applicants understandably look for ways to shorten the wait. Congressional inquiries can have a role, but they should not be treated as a shortcut around normal USCIS processing, even if it seems substantially delayed.

For applicants who want USCIS to look into a case, congressional assistance may help. For those who want a defined adjudicative timeframe on an eligible NIW I-140, Premium Processing is a fundamentally different tool.
